The Act defines ‘tobacco advertisement’ more broadly than the everyday meaning of the term. Section 9 of the Act defines a ‘tobacco advertisement’ to be any writing, still or moving picture, sign, symbol or other visual image that gives publicity to, or otherwise promotes or is intended to promote, smoking or the purchase or use of tobacco products.
You could argue that my van without the logo breaches the act however I would argue that anyone under the age of 18 who recognises the link between my van and smoking has more than likely been exposed to smoking by a parent or friend long before they saw it. Yours is little less subtle so you could encounter some issues if any do-gooder gets on their high horse after seeing it. I hope not as it does look great and to be completely honest, its what enthusiasts want to see. Its the most asked question when people approach me. "Are you putting the Marlboro logo on it?"
