Basically, the bottom line as that anything that has a GMH logo, etc can only be done by Rare Spares..

The positives would have to be that the tooling doesnt get destroyed. The negative would have to be that they will corner the market price wise and have total control over what does and does not get made.
Probably wont have much effect on the hq-wb series anyway will it? That tooling would have all changed hands or been destroyed years ago wouldnt it?

There is no tooling. What there is, its already being used. Quaility will not improve.

Sandman stripes. These may not happen now. Sorry guys. There maybe many many sandmans out there without the stripes.

Maybe able to sell them though rare spares. But Id expect by the time rares put their bit on it they would be in excess of $700 a set.

I think you guys are reading more into this than it actually is. Holden cannot stop anyone from reproducing vehicle spare parts to be sold as "non-genuine spare parts".

I seriously doubt the name "Sandman" could be trade marked by Holden as the name was around long before Holden decided to use it on their vans and utes of the 70's. They probably would have registered the decal design but that registration has long since expired. What you can't do is use the GMH logo or sell any reproduction parts as GMH or Holden approved reproduction parts whereas Rare Spares can.

In the case of the tail tents Holden can't stop anyone from reproducing them but you do need their approval to print the Holden Lion logo on them.

All Rares have done is gain the right to purchase original Holden tooling that Holden no longer requires. Good for them in 30yrs time when VE Commodores become classic cars.

Up until the new designs act 2003 which came into effect in June 2004 you could register a design for a maximum period of 16 years, initially for 1 year and then 3 x 5yr renewals... an aftermarket company can reproduce parts if the design is no longer registered. Our early Holdens have long passed the expiry date on registered designs.

Under the new act a company can manufacture non-genuine spare parts for any vehicle manufactured after June 2004 without infringing registered design. Design registration is now a maximum of 10 years.

I considered doing them years ago when I found out the other fellow wasn't making any more and looked into the legalities of it (how I found out about the designs act) by consulting a Lawyer. Was pondering the demand for them and whether they would be viable when you anounced you were going to do them so I didn't bother proceeding.

Don't take my word for it though, if you are concerned I suggest you get professional legal advice.

Yes I guess I was frustrated. Still am. But not the end of the world. Too far committed into them now mate.

Also the 40 odd people on my list would be shattered!
