Never had a problem cruising with it up in SA..
Like the look cruise with it up but must put a bit of pressure on the hinges..

ive always had it up, never had an issue, even got pulled over once with a couple people in the back, never had an issue there either they just checked that no one was 16 or younger.

i would say technically no.
in WA. the exhaust must be 900 mm past the last opening point. e.g sidepipe, 900mm past the door
but that doen not mean 900mm past the tailgate though!

My take on it is that I think the open tail gate would be an over length load and therefore ellegal in all states because when it is open it overhangs the rear light more than 150 mm .it would be legal if you tied a red flag to it because you can then over hang up to 1200 mm
Ive never heard of anyone been book for this though

I thought that it was a fixed 1200mm overhang for the front but in the NT there is some bizzare formula that has something to do with the distance behind the centre of the rear axle in relation to the distance between the front and rear axle divided by the number of spanners in a sidchrome tool kit.

In w.a. you can drive with your tailgate open as far as i know its not illegal having said that with all the laws changes who knows
you cant have anything longer that 1200mm past the back of your car van whatever it is your driving
My guess would be if you had anything in the back you would be a sitting duck for un-secured load. But it probably comes down to who pulls you over.
