Are you allowed to drive with tailgate open?

Just wondering if anyone knows if you are allowed to drive with the top tailgate open, besides being gassed out with petrol fumes it does look kinda cool especially cruising along the beach.
In this day and age you probably loose 15 points off your licence and have your car impounded or something, I remember back in the day the old postie vans with the sliding doors( I think they were Bedfords ) you could drive with the door open.
Interested to hear people's opinions , have you been pulled over for it !
    Cheers
    Ben

I DO drive with the top rear tailgate open.
Not that I drive it that much, but I've never had a "police" issue.

I dont see it as any different to winding the rear window down in your H series station wagon.

And its a thousand times easier to see out the back.

I always used to when I had a van. I also used to drive around in my FJ40 with the doors off.

Its not an issue in NSW nor should it be, can remember when I was a kid and my dad had panelvan for his business and we use to take 3/4 of my soccer team to away games and we would have a heap of fun with the tail gate up, throwing lollies etc out the back.

I see my mates triton dual cab ute has an electric rear window in the cab as standard, so i would imagine that if this passes so would havinging the tail gate open.
I always had the rear window open on my HZ wagon just so you could hear the exhaust note.

More of a problem of exhaust fumes than the cops. Never had an issue here. (VIC)

I've got a van as a daily and drive around with the back up 90% of the time with no issues.
I got pulled over for an RBT a few weeks back and the guy made the comment that it must be pretty good having the breeze going through, so zero issue there.
I know of a member here who got pulled over and instructed to shut it immediatly as it was a saftey issue.

I think at the end of the day it's down to the cop being a person that's going to have good and bad days. Plus how you talk to them always makes a massive difference.
