    New car contracts?

    Hi all, I was just after some information about about my rights with contracts for new cars. When Holden was having its 4 day sale I put a deposit down on a Barina X for our business. There was a limited number of 700 made and I was garenteed there was plenty of available stock and they would have to get one through another Holden dealer. Now a week later they tell me can't secure a vehicle... I have even give them a choice of 2 colours now. I'm just not sure if it's gotten to expensive or difficult for the dealer...but how would I really know? I'm going to contact another Holden dealer tomorrow and see if they can get me one in. Really they should be obligated to get the car in if I have signed a contract or is this not the case? Interested in your thoughts.

    I agree 100%. Of course they should honour it. Or is Holden now part of the NRL.

    Just spoke with my better half about this,as she has worked in the industry for many years and she said that the reason is that they may no longer be able to secure a car as each dealer will be allotted a set number of cars. If they haven't been given the colour you want they may be able to swap there car for one at another dealer. However this would require the other dealer to want the colour they are offering and want to do the swap, they might be wanting to hang onto what they have if the cars are rare and in demand.
    As to supply a car you will probably find in the contract that there will be a clause about subject to availability. While the salesman would have assured you that there was one available and just sign here, the reality may be very different and now the hard sell will start with" I can't get you that car but I have this one that I can do for the same price".
    The bottom line is if they can't supply the car they will have to refund the deposit, doesn't help you as you want the car.

    If they don't have a car, what exactly is it you would want them to do?

    I'd go back to the dealer and negotiate another vehicle. Be clear calm and consistent with what you want. Also get quotes from as many other dealers as you can reasonably get to. Sometimes its amazing the difference you'll find. What was the original deal - must have been pretty good? I've leased a few Barinas and the 1.4 turbo is a ripper if the budget stretches that far.

    Probably not waste my time as I'm looking for a tax deduction this financial year....At the time of signing the contract the salesman assured me there were quite a few on there system. Typical salesman

    Cheers Sandasharpe, it was an excellent deal. We live in a regional area so I can only enquire in the city. I test drove Barina and was presently surprised with it.

    I seen an ad for the limited edition Barina X on tele last night. Still waiting to see one for the Sandman....
    Always for careful when you sign a contract. That said if you can substantiate what the salesman said you would get your money back. But this won't get you the car!

    So this is slightly different. I took delivery of the best Triton yet, 2016 exceed model.. My 4th in a row and my last ever. Day 3 of ownership I drove for 2 hours with a owner manual behind my back for the last hour due to a nasty seat. ( do not buy this ute). I rang the dealer before I arrived and told him no matter what it's coming back. Is this going to cost my left nut? Has anybody else had to do something similar? Again, don't buy this model ute.
