contract law or fair trading legislation
Is all well and good, and it is there in New South wales as it would be in any state, however, getting theses bodies (Dept of Fair Trading and A.C.C.C) to act on your behalf is a totally different thing.
In New South Wales a positive outcome will not happen through any intervention by the Department of Fair Trading nor the A.C.C.C.
I know this from personal experience when attempting to deal with Jeep Australia re our dodgy Jeep Grand Cherokee Overland we purchased from Five Dock Chrysler Jeep Dodge.
All the Department of Fair Trade will do is take a report and lodge it against the business you complain about. That's it.
They then flick you to the A.C.C.C.
The A.C.C.C take a report from you and ask what you want done, i.e repair/replace/refund. They then send your 'wish-list' to the business/individual you have a grievance with. That's it.
Five Dock Chrysler Jeep Dodge basically told me to kick rocks, as can an individual. A.C.C.C will go no further than that. The ball is now in your hands to go through civil court.
In New South Wales the above mentioned bodies are toothless tigers.
